| TERMS & CONDITIONS | |
|
Both parties to this Contract agree that these Terms and Conditions form part of the Contract Agreement between the first party Telford Multimedia Limited, hereafter called "Telford Karaoke & Disco" and the second party i.e. the person/persons booking the Media services, hereafter called "the Client". It is also agreed that no subsequent changes or modifications will be made to the Contract without the agreement in Writing of both parties. STANDARDS Telford Karaoke & Disco shall at all times strive to maintain the highest standard of workmanship and artistic ability and work within the reasonable terms set by the client or by any Official or person possessing the correct and legal authority to set limitations or restrictions. Telford Karaoke & Disco shall not be responsible for non-fulfilment of the Contract if restricted by unreasonable limitations. PAYMENT AND DEPOSIT A deposit shall be payable by the Client on booking. The deposit shall be £30.00 unless otherwise set out by Telford Karaoke & Disco at the time of booking. Because of the difficulty in obtaining replacement bookings this deposit will not be refunded if the Client cancels or purports to cancel the Contract. Telford Karaoke & Disco may invoice the Client for the event fee or any other sums due under the Contract to be paid prior to the Event. Event settlement payments by cheque must reach Telford Karaoke & Disco no later than 10 working days prior to the event. A chargeable fee to the Client will be made by Telford Karaoke & Disco on any failed cheques. The Event fee must be paid in full before the start time of the Event. If the Client fails to make any payment on the due date, then without prejudice to any other rights available to Telford Karaoke & Disco, Telford Karaoke & Disco may refuse to provide service and cancel the contract or any other Contract with the Client and claim damages from the Client for breach of Contract. The price (unless otherwise stated) is inclusive of any applicable VAT or like taxes or other duties that the Client shall be additionally liable to pay to Telford Karaoke & Disco. Telford Karaoke & Disco may charge the Client interest both before and after any judgment on the amount unpaid at the rate of 4% above the bank base rate for the time being on a day to day basis until payment in full is made. Such interest to be calculated from the date of the event. CANCELLATION The Contract is subject to alteration or cancellation by Telford Karaoke & Disco if the Event is subjected to any cause or non-compliance or failure beyond his control. The Client may cancel the contract only in Writing on any date prior to the date of the Event. If notice of cancellation is received by Telford Karaoke & Disco 30 days or more before the Event, Telford Karaoke & Disco may charge a cancellation fee equal to 100% of the event fee only if Telford Karaoke & Disco is unable to arrange an alternative booking on the date of the Event, and/or if any retained deposit does not adequately compensate Telford Karaoke & Disco. The Client may not cancel the contract on or after the date of the Event, and if the Client purports to do so, Telford Karaoke & Disco may make a charge to reflect all work done up to the date of invoice. In the unlikely event of failure before or at the Event by equipment and/or media etc. owned and/or used by Telford Karaoke & Disco and resulting in cancellation of the contract by Telford Karaoke & Disco, any liability of Telford Karaoke & Disco to the Client will be restricted to a full refund of all monies paid. Telford Karaoke & Disco will not be liable for any consequential loss howsoever caused. LOSS/DAMAGE The Client is responsible for any loss or damage to Telford Karaoke & Disco equipment caused by person or persons’ at the Clients event. The Client will be invoiced the full cost for any resulting repairs or replacements. STANDARDS Event staff of Telford Karaoke & Disco will not tolerate violent, aggressive or abusive behavior from anyone under any circumstances. Telford Karaoke & Disco reserve the right to terminate our services immediately if it is deemed a staff member’s safety is at risk. ARTIST/SONG TITLE PLAY-LIST A Clients’ artist/song title play-list must be available to Telford Karaoke & Disco no later than one week prior to the event. When less than 7 days remains to the event, an artist/song title play-list will only be accepted at the discretion of Telford Karaoke & Disco. Once a Clients’ artist/song title play-list has been submitted and accepted by Telford Karaoke & Disco, no further artist/song title requests will be accepted at the venue by Telford Karaoke & Disco without prior consultation, and acceptance from the Client. Telford Karaoke & Disco must be allowed reasonable artistic license in the use of any artist/song title submitted. Telford Karaoke & Disco will at all times strive to maintain the highest standard of workmanship and artistic ability in regard to the event music content. On the day of the event Telford Karaoke & Disco cannot guarantee the availability of any artist or song title requested on demand. SETUP & EQUIPMENT On gaining entry to the Client’s venue, Telford Karaoke & Disco require a minimum setup time of 1 hour, and the same amount of time to break the equipment down at the end of the Event. If Telford Karaoke & Disco is working alongside other booked entertainment (e.g. Singer, Comedian, Band etc) consideration must be made of workable space where Telford Karaoke & Disco’s setup will be. Approximately 14 feet of stage space is required for a full set-up to include lighting. If Telford Karaoke & Disco is required to link its equipment with a fixed in-house audio system, (or with any mobile singer/band equipment,) and if Telford Karaoke & Disco considers it to be unsafe or liable to cause damage to Telford Karaoke & Disco equipment we reserve the right to refuse to do so. Telford Karaoke & Disco reserve the right to refuse to play any individual song/artist where content may offend or be deemed inappropriate for the Event. Smoke or fog machines will only be used by Telford Karaoke & Disco at the presenter/show hosts discretion, or with permission from management from the venue. Smoke machines will not be used in poorly ventilated rooms, in an area where non isolatable fire or smoke sensors are present or in function rooms where any objects or people are likely to be in range of the smoke machine. SOUND LIMITING DEVICES Should it be deemed necessary to do so, Telford Karaoke & Disco reserve the right to refuse to work in venue's which have sound limiting devices installed. If such a device is fitted a smaller show is usually provided. Once tripped, many sound limiters work by cutting the mains power supply to where the equipment is plugged in. A severe shut down as this could cause serious damage to computer based sound equipment, powered mixers, controlled lighting, amplification hardware etc. Alternatively, with venue management approval and established sound volume levels, power can be taken from an uninterrupted supply. GENERAL If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected thereby.
